Here you can find the terms of use for the IT Service Center's 'AI for Everyone'
1. Scope
The access to the service 'AI for Everyone' is restricted to the qualifying status as a member or associate of the Justus Liebig University Giessen – students, lecturers, and staff members.
2. Services
The service provides functions in the area of generative artificial intelligence (AI). Users can use the service to create media such as texts or images. For this purpose, users initiate inputs, e.g., in text form, which are processed by the service based on AI systems and produce an output. The service can be accessed, among other things, through a web browser. The service also provides the ability to share inputs and outputs with other users.
3. Purpose of Use
The use of the service is exclusively for purposes of study, teaching, research, qualification procedures such as doctoral and habilitation, university administration, and for official duties for which JLU is responsible. The user is not entitled to use the service for private purposes. The user is also not permitted to make their access to the service available to third parties for use. In particular, it is prohibited for them to share their credentials and password. However, they are entitled to share links to and reproductions of inputs and outputs of the service with third parties, provided that this transmission is lawful and permissible.
4. General Provisions
These terms of use supplement the general terms of use of the connected language models and do not claim to be complete. All users are responsible for complying with these provisions.
5. Obligations of the User
5.1 Protection of Third Party Rights
The use of the service must comply with all third-party rights. Violations may lead to exclusion from the service, without prejudice to other criminal or civil law consequences.
- Retrieving, offering, uploading, or distributing unlawful content, particularly content that violates criminal, personal rights, license rights, or copyright provisions, is prohibited.
- No automated decisions may be made pursuant to Art. 22(1) GDPR that have legal effects or similarly significant effects on the person concerned. The final decision-making authority, especially regarding labor and personnel decisions, must remain with a natural person.
- When transmitting data, applicable contractual agreements, legal provisions, and internal JLU guidelines must be observed, especially confidentiality agreements, duty to maintain service secrets, or legal requirements.
- When using external AI models, no materials intended for internal use may be submitted as input.
- When using local AI models, materials intended for internal use may be submitted as input.
5.2 Personal Data of Third Parties
When using local AI, personal data may be used for official purposes as input if required for the above-mentioned purposes.
When using external AI, input of personal data under Art. 4(1) GDPR as input in the service is generally prohibited. This includes, among others:
- Full name
- Contact details
- Email address
- Nationality
- Gender
- Age
- Marital status
- Photo, audio, or video recordings
The only exception is the mention of the author in the input of copyrighted works in the service. In this case, written consent of the author must be obtained before entering their personal data. The legal basis for data processing is therefore the consent of the author under Art. 6(1)(a) GDPR. According to §13 UrhG, the author is free to waive attribution. A waiver must be documented in writing. Entry of special categories of personal data under Art. 9(1) GDPR is not allowed. This includes:
- Data revealing racial or ethnic origin
- Data revealing political opinions
- Data revealing religious or philosophical beliefs
- Data revealing union membership
- Genetic data
- Biometric data for uniquely identifying a natural person
- Health data
- Data concerning a natural person’s sex life or sexual orientation
5.3 Penalties for Violations
JLU has the right to immediately suspend access to the service if there is a reasonable suspicion that the stored data is illegal and/or infringes third-party rights. A reasonable suspicion of illegality and/or infringement exists in particular if courts, authorities, and/or other third parties notify JLU of this. Other violations of these terms of use, especially obligations under §§4(1)-2 and misuse for purposes other than those mentioned in §3, also entitle JLU to suspend the user. Affected users must be notified immediately of the suspension and the reason. The suspension will be lifted once the suspicion is cleared.
